If you get rear-ended in New York State do you go through the other driver’s insurance or yours?

I was rear-ended, the guy who hit me claimed that since New York is a no-fault state my insurance would go up too regardless of fault. He offered to pay for the damage, which wasn’t much, so we parted ways and no police report was filed (my first mistake, it seems) but once I got the estimate he balked because the collision shop recommended I replace the bumper (it was the second time i was rear-ended on the same bumper) and the amount seems unrealistic. I went to another shop and they said they couldn’t guarantee their work on top of the previous shop’s work, and to go back to the original guy, who recommends replacing the bumper for $741. The guy who hit me is offering me $300 take it or leave it. Can I go (or could I have gone) through the other guy’s insurance?

If i were you, i would call my insurance company and ask what you should do. if its his fault, he needs to pay for the damages. I was in an accident last week and it was the other person’s fault. my insurace gave me two options:
1) go through them, they pay for everything, except dedutables and such… and they then get reimbursed through the other insurance, and will send you the check for the deductibles that you paid

or

2) call the other insurance and file a claim with them and deal directly with them (which is what i did since i have liability only and i would have had to pay 1500 to fix my car and then wait to get reimbursed)
