Is it illegal for an insurance agent to tell the insured not to tell an adjuster about mold in the residence?

I called an agent about roof damage and mentioned that I have mold in my attached garage, he told me not to mention it to the adjuster when he comes out. When I asked him why he said it would not be covered because it would have been a preexisting condition if mold was present. I have had this homeowners policy for 16 years!

That agent may or may not be correct about the coverage, but more than likely, it WOULD be a second claim.

If this would be a second claim, and covered, then what the agent did was wrong. Keep in mind, though, that policies that DO cover mold, limit the mold remediation coverage to $5,000, and then YOU have to pay the rest.

If it ISN’T covered, it’s fraud, for withholding important information.

The existance of mold, however, is going to 1. pretty much guarantee that your policy will be cancelled and 2. make it darned hard for ANY insurance company to give you coverage in the future.

So even if it’s illegal and unethical to give you that advice, it’s still probably in your best interest to NOT mention the mold.
